Terms of Sale

1. Products & Pricing

• Entry Coin — $250. Includes one sweepstakes entry into the drawing open at time of purchase, subject to the Official Rules and the one-entry-per-person-per-drawing limit.
• Turnover Silver — $150. No sweepstakes entry attached. No purchase quantity limit.
• Pledge / Collector Coin — priced per the pledge page's current tiers. No sweepstakes entry attached, regardless of tier. No purchase quantity limit.
• Vouchers — priced per the current voucher program terms. Redeemable for one (1) sweepstakes entry per voucher, single use only.

All prices are listed in U.S. dollars and are subject to change without notice for future purchases; the price charged is the price displayed at checkout for that transaction.

2. Order Acceptance

Your order is an offer to purchase, which BMD may accept or decline. An order is not accepted until payment is successfully processed and you receive confirmation. BMD may cancel or refuse any order at its discretion — for example, for suspected fraud, pricing errors, or if a product is no longer available — in which case any payment collected will be refunded.

3. Payment

All payments are processed through Stripe. BMD does not collect or store your full payment card number. By placing an order, you represent that you are authorized to use the payment method provided.

4. Shipping & Delivery

Entry Coin production is threshold-gated: minting, engraving, and shipping for a given drawing begin only after that drawing's minimum entry requirement is confirmed met. As a result, delivery timing for an Entry Coin purchase depends on when (and whether) that drawing's minimum is reached, not on the date of purchase.

Turnover Silver, Pledge/Collector Coins, and voucher fulfillment are not threshold-gated and should ship within the timeframe stated at checkout.

The Sweepstakes Prize (the gold coin awarded to a drawing's winner) is delivered per the Official Rules, which provide for hand delivery or mailing at Sponsor's discretion.

5. Sales Tax

Under Texas Tax Code § 151.336, sales of gold, silver, and numismatic coins are exempt from Texas state and local sales tax, with no minimum purchase amount. Accordingly, Products shipped to a Texas address are not subject to Texas sales tax.

6. Risk of Loss & Title

Risk of loss and title to a physical Product pass to you upon BMD's delivery to the carrier, except where BMD has agreed to hand-deliver. BMD is not responsible for loss or damage occurring after delivery to the carrier, though BMD will assist in good faith with a carrier claim if a shipment is lost or damaged in transit.

7. Returns, Refunds & Cancellations

• Entry Coins: refundable in full only if the associated drawing is cancelled for not meeting its minimum entry requirement, per the Official Rules. Otherwise, sale is final.
• Turnover Silver: sale is final. No returns or refunds.
• Pledge / Collector Coins: sale is final regardless of any drawing's outcome. No returns or refunds.
• Vouchers: sale is final once issued. Lost, stolen, or destroyed vouchers will not be replaced or refunded.

If you believe you received a defective or materially incorrect Product (for example, wrong item shipped), contact BMD within a reasonable time of delivery so it can be corrected; this is separate from, and does not expand, the refund rights described above.

8. Product Descriptions

BMD makes reasonable efforts to accurately describe each Product, including metal content and weight. Minor variations in appearance between listing photos and the Product received (such as natural finish variation in silver) are not considered a defect. Sweepstakes Prize value is stated in the Official Rules and is re-verified close to each drawing given gold price movement.

9. Limitation of Liability

To the fullest extent permitted by law, BMD's liability for any issue arising from a purchase is limited to the amount you paid for the Product giving rise to the claim. BMD is not liable for indirect, incidental, or consequential damages arising from a purchase.

10. Governing Law

These Terms of Sale are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any disputes will be resolved exclusively in the appropriate courts located in Texas.
